Bicycle & Pedestrian Accidents

Most bicyclists and pedestrians are aware of the possible hazards of riding or walking near a roadway. California Bicycle Laws

In California, bicyclists have the same rights and responsibilities as drivers of other vehicles. There are some special rules for interactions between motorists and bicyclists, however:

• Vehicles must give three feet of space when passing or driving alongside a bicyclist.
• No one is allowed to obstruct a bicycle lane – in a vehicle or bicycle.
• Bicyclists have the right to “take the lane” when passing, turning left, avoiding hazards, or when the roadway is too narrow.
• Bicyclists may not ride on the freeway or cross troll bridges without permission.
• Bicyclists must travel in the same direction as traffic on the roadway, except when passing, making a legal left turn, riding on a one-way street, riding on a road that is too narrow, or when the right side of the road is closed due to road construction.

Pedestrian Accidents in California

Pedestrian accidents occur far too frequently in California. Many of our cities have sidewalks, and walking paths near the road or that cross the road. Unfortunately, this puts pedestrians at risk. Most pedestrian injuries and deaths are caused by negligent driving. Examples include speeding, driving under the influence of alcohol or drugs, texting while driving, etc.

Can I File an Accident Claim after a Bicycle or Pedestrian Accident?

California law allows bicycle and pedestrian accident victims two years to file a lawsuit. This is called the statute of limitations.
